Albany Man Sentenced For Gun Possession

Albany County District Attorney Lee C. Kindlon announced today that a 40-year-old Albany man has been sentenced to state prison for possessing a handgun on a bus.

The Honorable Andra Ackerman sentenced Brendon Marino to serve five years in state prison followed by five years of post-release supervision after he pleaded guilty to Criminal Possession of a Weapon in the Second Degree.

On March 12 at around 9:45 p.m., Albany Police, Albany Fire and Mohawk Ambulance crews were called to Delaware Avenue for reports of a man passed out on a CDTA bus. As the man was being loaded onto a stretcher, Officers noticed a .45-caliber handgun sticking out of the man’s waistband.

The gun was removed and found to be loaded with four live rounds. Marino, who did not possess a valid state permit to carry a gun, was taken to Albany Memorial Hospital for treatment and later arrested.

Assistant District Attorney Marissa Schatzel of the Street Crimes Bureau prosecuted the case.
